General Terms and Conditions of the Aeronautica Militare Online store

1. Definitions

Price – the amount you pay for the Goods.
Shipping Cost – the delivery fee (including packaging).
Total Price – the sum of the Price and Shipping Cost.
VAT – Value Added Tax in accordance with applicable legislation.
Invoice – a tax document (in electronic or printed form).
Order – your binding offer to purchase Goods.
User Account – a registered customer account on the e-shop.
Buyer / You – the person purchasing through the e-shop.
Goods – products offered for sale on the e-shop.


2. General Provisions

2.1. Purchases may only be made through the e-shop.
2.2. You must provide accurate, complete, and up-to-date information when making a purchase.
2.3. Product reviews displayed on the e-shop are verified with actual orders to ensure authenticity.
2.4. The Seller fulfills all information obligations in accordance with consumer protection and e-commerce laws (e.g. identification data, pricing, shipping, and payment details must be clearly displayed).


3. Conclusion of the Contract

3.1. The Contract is concluded in the Czech language.
3.2. The Contract is concluded remotely via the e-shop interface.
3.3. The Order must include:
 a) product details (type, quantity)
 b) price, shipping cost, payment and delivery method
 c) identification and contact details (name, address, e-mail, phone)
3.4. The Contract is concluded upon submission of the Order and confirmation by the Seller via e-mail.
3.5. If the ordered Goods are unavailable, you will be notified without delay and offered an alternative or cancellation option.
3.6. If an obviously incorrect Price is listed, the Seller is not obliged to deliver the Goods at that price and will offer a revised proposal.
3.7. Upon conclusion of the Contract, you are obliged to pay the Total Price.


4. User Account

4.1. You may create a User Account to simplify future purchases and view order history.
4.2. Registered information must be truthful and updated when necessary.
4.3. Account access is protected by a password; you must not share your login details.
4.4. The User Account is personal and non-transferable.
4.5. The Seller reserves the right to cancel inactive accounts (after 2 years of inactivity) or in case of a breach of obligations.


5. Price and Payment

5.1. Prices include VAT unless stated otherwise.
5.2. The Total Price includes both the product price and the delivery fee.
5.3. Available payment methods:
 a) bank transfer – due within 2 days of order confirmation
 b) online card payment (e.g. via payment gateway)
 c) cash on delivery (COD) – payable upon receipt
 d) cash payment upon personal pickup
5.4. The Seller issues an invoice (usually electronically) once the Total Price is paid.
5.5. Ownership of the Goods transfers to the Buyer only after full payment and acceptance of the Goods.


6. Delivery and Transfer of Risk

6.1. Goods are delivered within 7 days of order confirmation, unless stated otherwise.
6.2. Delivery methods:
 a) personal pickup at the store
 b) courier delivery (e.g. Česká pošta, PPL, etc.)
6.3. Delivery is available within the Czech Republic and states of EU.
6.4. Risk of damage transfers to the Buyer upon receipt. If the package shows signs of damage or tampering, do not accept it and contact us immediately.
6.5. If repeated delivery is required due to Buyer’s actions (e.g. wrong address, absence), additional delivery costs shall be borne by the Buyer.
6.6. If the Goods are out of stock, you will be informed about the expected delivery or potential cancellation.


7. Defective Performance Rights

7.1. Goods must, upon transfer of risk, conform to their description, quantity, quality, functionality, and agreed properties.
7.2. The rights related to defective performance follow the Civil Code (Act No. 89/2012 Coll.) and the Consumer Protection Act (Act No. 634/1992 Coll.).
7.3. In the event of a defect, you may request:
 a) correction of the defect (repair or replacement),
 b) a reasonable discount, or
 c) withdrawal from the Contract if the defect is material, recurring, or not remedied in a reasonable time.
7.4. Complaints are processed within 30 days from submission.
7.5. Consumers may claim defects within 24 months of delivery.
7.6. Legitimate complaint-related costs (e.g. transport) are covered by the Seller.


8. Withdrawal from the Contract

8.1. Consumers have the right to withdraw from the Contract without stating a reason within 14 days of receiving the Goods.
8.2. Withdrawal must be made in a verifiable manner (e-mail or letter). A sample form is available.
8.3. Returned Goods must be sent back within 14 days of withdrawal notice. Return shipping costs are borne by the Buyer unless agreed otherwise.
8.4. Refunds are processed using the same payment method used for purchase unless agreed otherwise.
8.5. Withdrawal rights do not apply to customized or altered products.
8.6. Returned Goods must be in the same condition as upon receipt. Any decrease in value beyond normal use may be deducted from the refund.


9. Consumer Dispute Resolution

9.1. Complaints can be submitted via e-mail to eshop@aeronauticamilitare.cz.
9.2. Out-of-court consumer dispute resolution is handled by the Czech Trade Inspection Authority (Česká obchodní inspekce), Štěpánská 44, 110 00 Prague 1.
9.3. In cases involving an international element, Czech law shall apply. Consumer rights under mandatory local laws remain unaffected.


10. Final Provisions

10.1. These Terms and Conditions may be amended. Changes apply only to contracts concluded after the effective date.
10.2. Users with an active account or recurring orders will be informed at least 14 days in advance of any changes.
10.3. In cases of force majeure (e.g. natural disasters, pandemics, supplier failures), the Seller is not liable for delays or damages. If force majeure persists for more than 10 days, the Seller may withdraw from the Contract.
10.4. All legal relations are governed by the laws of the Czech Republic.
10.5. Electronic communication (e-mail) is considered equivalent to written form.
10.6. These Terms and Conditions are effective as of November 11, 2025.
